Kantor & Kantor, LLP secured a major appellate victory when the Ninth Circuit reversed a district court ruling that had upheld the denial of health insurance benefits to union dockworkers under a multiemployer ERISA plan. Represented by Founding Partner Glenn R. Kantor, the workers challenged the plan’s refusal to cover facility fees for outpatient surgical care. The appellate court ruled that the denial lacked a reasonable basis, even under a deferential standard of review, and sent the case back to the lower court – reviving approximately $4.1 million in disputed benefit claims.
