ERISA: Beyond the Basics CLE Program

This 3-day virtual program will showcase the legal expertise of dozens of ERISA practitioners from all areas of the field. Day 1 will focus on Health and Welfare Plan Compliance and Regulatory Updates, including MHPAEA, the No Surprises Act, and the Consolidated Appropriations Act.
Day 2 will focus on Retirement Plan Compliance and Regulatory Updates, including Secure 2.0, the Fiduciary Rule, Section 409A, ESG, and plan design considerations.
Day 3 will address ERISA Litigation Hot Topics, including the enforceability of arbitration provisions, fiduciary breach, and fee-related litigation in defined contribution plans, MHPAEA and mental healthcare claims, and disability benefits claims.

Elizabeth Hopkins, Senior Partner at Kantor & Kantor, LLP, will be one of the panelists presenting on Day 2 for the session on Fiduciary Rule. On October 31, 2023, the U.S. Department of Labor unveiled its proposed Retirement Security Rule. This Rule will replace the familiar five-part test for fiduciary status in connection with investment advice. Prior rules have faced substantial litigation challenges. This panel will give an overview of the Rule. Topics will include:
- The Rule’s history, including prior proposals to redefine fiduciary status;
- What the proposed rule would do, and how it differs from the current five-part test; and
- What the proposed changes to the exemptions would mean for different advice providers (including those who are currently subject to SEC’s Reg BI and those who are not).
The other panelists alongside Elizabeth, will be Robert Gower from Trucker Huss, APC, and Phyllis Borzi, former Assistant Secretary with the Employee Benefits Security Administration (EBSA), U.S. Department of Labor.
