Kantor & Kantor, LLP represented an accountant who suffered from chronic fatigue and fibromyalgia. Her claim was denied by her disability insurer who failed to adequately consider the plaintiff’s attending physician’s diagnosis of total disability.

Kantor & Kantor, LLP filed suit and the Court granted summary judgment for the plaintiff, finding a conflict of interest existed which showed the defendant’s denial of benefits was unreasonable. The defendant was ordered to pay disability benefits to the plaintiff.
