Mental Health Difficulties Covered by Disability Insurance

What many insurance companies do not tell their policyholders is that disability insurance policies often include mental health difficulties, not just physical injuries and illnesses. In fact, if your long term disability coverage is provided through your employer, then it more than likely is governed by ERISA law. This federal statute will normally include mental health difficulties as a disability that validates a disability filing.

Some of the more common mental health difficulties covered in ERISA claims are:

  • Depression
  • Anxiety
  • Post-traumatic stress disorder (PTSD)
  • Bipolar disorder

Please be aware that this list is not fully comprehensive. There are many other mental health difficulties that can make continuing work unsafe or impossible and, therefore, can validate your need for LTD benefits. To learn if your mental illness is covered, you can review your disability insurance policy or call (877) 783-8686 to discuss your claim with our attorneys. We focus on cases that have been denied and need to be appealed or challenged.

Why Would a Mental Health Claim Be Denied?

Your mental health is just as important as your physical health, and any mental injuries need care and treatment like a physical injury. You cannot be as happy as you could be if your mental health is suffering. While you might accept the importance of your mental health, your disability insurance provider might not. Many insurance companies are notorious for ignoring or downplaying the mental health concerns of their policyholders.

A few reasons why LTD insurance companies deny mental health claims are:

  • Misunderstanding of the symptoms: Insurance adjusters and insurance company representatives might only be trained to evaluate disabilities caused by physical injuries and illnesses. “Invisible” injuries like mental health complications could be entirely foreign to them, leading them to misunderstand even obvious symptoms of anxiety, depression, and so forth. As a result, your mental health claim could be denied outright despite it being valid under the terms of your policy.
  • No diagnosis: It is important that you see a mental health professional for diagnoses, prognoses, and prescribed treatments. If your mental health difficulties have not been evaluated and recognized by a mental health professional like a psychiatrist, then your insurance company will likely deny your claim and have grounds to do so, making an appeal more difficult.
  • Expensive residential treatments: There are no insurance companies that like to payout policy coverage amounts, especially when those amounts are significant. To treat mental illnesses, most medical professionals agree that residential treatments like inpatient programs are the most effective and safest options. Residential treatment programs are expensive, though, sometimes costing as much as $30,000 for a 30-day program. You should not be surprised if your insurer denies your residential treatment claim without a clear reason, other than they do not want to have to spend that much money on your health.

Client Testimonials

  • There are no words that can express the feelings of gratitude and relief I have that you helped us.

“I wanted to thank you again for all of your help. My daughter would not be in treatment without your help. I can never thank you enough, there are no words that can express the feelings of gratitude and relief I have that you helped us, and I believe saved my little girl. Taking her back to Timberline Knolls was very difficult in many ways, I wish UBH could know the damage they have done to her by having her go in and out like this. When she went into Timberline Knolls the first time she was not happy to go exactly, no one wants to go into treatment, but she was open to going in and ready, for the first time, to really look at her issues and work hard to get better. When she had to leave Timberline she expressed that she wished she could have stayed because she felt like she was finally at a place where she was getting better and, though it was hard, she was really opening up and dealing with her issues for the first time, something she has had a hard time doing. I just wanted you to know that she was going down to a really bad place and without you I don't know what would have happened except that she would not be at Timberline Knolls right now getting better and I thought you should know this. With unending gratitude.”

  • Your compassion for me and my situation is very much appreciated.

“My thanks to you for pursuing my case with vigor. I don't know much about how these legal things are handled, but I could tell by your communications with me, making sure I was always informed, that you were on top of it all. Also, you were ALWAYS available to me to answer questions, and your compassion for me and my situation is very much appreciated. I have had limited exposure to the legal system and attorneys, but I have never been able to just call and talk to them, as I could with you. I always had to speak with someone in the office that couldn't really answer my questions.”

  • The light at the end of the tunnel was masked, but we found it!

“I'm sending my heartfelt wishes to you and your team for a wonderful holiday. We celebrate Christmas this year with a lighter heart than past years - knowing how you made a difference for us and for so many others. The light at the end of the tunnel was masked, but we found it! And so, cheers to you and your incredible team. Have a wonderful and safe new year.”

  • The arguments you made on our behalf at the mediation resulted in a more positive outcome for our case than we could have otherwise expected.

“We appreciate that you found merit in our case, and that you were both willing and able to be present at the mediation. We believe that the arguments you made in our favor to the mediator were able to influence the outcome towards resolution that we could feel satisfied with. In the end, we believe that your counsel, your support, and the arguments you made on our behalf at the mediation resulted in a more positive outcome for our case than we could have otherwise expected. Throughout you were always professional, but direct and clearly firm on our position. We thank you for your efforts to resolve our dispute to our satisfaction, and wish you continued success.”
