Synopsis
Participant brought action under ERISA against long-term disability plan and his employer, challenging denial of application for long-term disability benefits. Defendants moved for judgment on the pleadings on ground that participant failed to exhaust his administrative remedies by timely filing administrative appeal of denial. The United States District Court for the Central District of California, granted motion. Participant appealed
Outcome
Reversed and Remanded The Court of Appeals, Circuit Judge, in a matter of apparent first impression, held that under ERISA federal common law, 180-day period for participant to file administrative appeal of denial was extended from ending day of Saturday to following Monday, and thus participant timely exhausted administrative remedies by mailing appeal on Monday.
