About this session

Exploitation frequently reaches older adults through their insurance. Beneficiary designations are altered without the policyholder fully understanding what was signed. Long-term care or life policies lapse while someone else controls the mail and the finances. Annuities and long-term care products are sold to buyers who could not realistically evaluate them.

Diminished capacity runs through all of it. It is often what creates the opening for exploitation in the first place, and it is also what makes these situations hardest to address afterward, when the policyholder cannot reconstruct what was signed, when, or at whose direction. Appeal deadlines pass unnoticed. Authorized representative paperwork is missing or contested. The documentation that would show what happened was never created.

What will be covered

  • How financial exploitation surfaces in the insurance context, and the forms it most commonly takes
  • Warning signs for families and for professionals working with older adults
  • Which documents matter most, and which deadlines are the least forgiving
  • What options may remain once a problem has been discovered, including the circumstances in which capacity concerns can strengthen a challenge rather than complicate it

Who should attend

Anyone caring for an aging parent or spouse, along with ombudsmen, Adult Protective Services staff, social workers, care managers, elder law practitioners, and others working with older adults. No legal background is needed.
